Terms & Conditions of Service
These Terms & Conditions ("Terms") govern all services provided by Power-Drones ("the Company") to its clients ("the Client"). By booking or accepting services, the Client agrees to these Terms.
1. Bookings, Deposits & Cancellations
1.1 Deposit
A 25% non-refundable deposit is required to secure your booking. This deposit is deducted from your total and will be forfeited if you cancel.
1.2 Client Cancellations
- More than 24 hours' notice: Deposit forfeited; no further payment required.
- Less than 24 hours' notice: Full payment required.
1.3 Company Rescheduling
We may reschedule due to adverse weather, aviation restrictions, equipment issues, or safety concerns. You will be offered the next available date at no extra charge, or a full refund including your deposit.
2. Risk Assessments & Compliance
2.1 Risk Assessment
Prior to any flight, the company will conduct a risk assessment in accordance with UK aviation laws and best practice guidance. Flights will only proceed if the responsible pilot deems the area, and conditions safe and compliant. If the flight cannot be completed for reasons outside of the clients control (ie weather), the flight can be rebooked at no extra charge, or refunded if time sensitive (ie a wedding).
2.2 Client Responsibilities
The Client must provide accurate site information and disclose any known hazards or access limitations. Failure to disclose relevant information may lead to delays or cancellation without refund.
2.3 Risk-Control Documentation
Where required (e.g., commercial shoots, events, construction sites), the Company will produce standard risk-control documentation. Bespoke or extensive safety documentation may incur an additional fee.
3. On-Site Operations
3.1 Planned Tasks
All tasks will be carried out strictly in accordance with the pre-agreed brief. Any additional shots, unplanned locations, or expanded scope may incur extra charges.
3.2 Safety Authority
The pilot in command has absolute authority regarding safety. If the pilot deems any flight unsafe due to weather, environment, public presence, or unexpected hazards, the flight will be postponed or cancelled without liability.
3.3 Accommodation for Multi-Day Sessions
Where services require travel beyond a single day or involve multiple days, the Client agrees to cover base hotel accommodation and subsistence costs.
4. Fees, Travel & Additional Costs
4.1 Travel Arrangements
Travel costs are chargeable for locations outside of the Company's base area. Mileage, public transport, parking, tolls, and any logistical arrangements will be invoiced to the Client.
4.2 Additional Editing Costs
Basic editing (colour correction and trimming) is included where agreed. Advanced editing, creative direction, titles, overlays, audio, multi-version output, or revisions beyond the initial agreement will incur additional charges.
5. Damage, Liability & Waivers
5.1 Damage Waiver
The Client agrees that the Company shall not be liable for damage or loss arising from circumstances outside the Company's control, including unexpected environmental changes, third-party interference, or hidden hazards.
5.2 Property & Access
The Client warrants that they have the legal right or permission to allow drone operations over the property. The Client indemnifies the Company for any claims arising from unauthorised access or filming requests.
5.3 Limitation of Liability
Liability is limited to the total value of the contract. The Company accepts no responsibility for consequential loss, project delays, or financial impact resulting from rescheduling or cancellation due to safety.
6. Ownership & Usage Rights
6.1 Content Ownership
Raw footage and images remain the property of Power-Drones until full payment is received. Upon payment, the Client is granted a non-exclusive licence to use the delivered content for the purposes agreed.
6.2 Company Portfolio Rights
The Client grants the Company permission to use selected images or video for promotional, training, and portfolio purposes unless expressly declined in writing at the time of booking.
6.3 Third-Party Restrictions
The Client may not sell or licence the footage to third parties without written permission unless such rights are included in their package.
7. General
7.1 Force Majeure
The Company is not liable for delays or failure to perform due to circumstances beyond its control, including weather, technical failure, illness, regulatory restrictions, or emergency incidents.
7.2 Governing Law
These Terms are governed by the laws of England and Wales. Any dispute shall be resolved through good-faith negotiation before legal action is taken.
